Good governance can be maintained if the bureaucracy and justice system are improved. Nepal’s constitution has also emphasized on sustainable peace, prosperity and good governance. The work done at the political and policy level is very important, but the daily work is done by the employees. It is said that bureaucracy is permanent government.
The direct work of the government can be seen in how the traffic police, local police, employees of various local level agencies behaved towards the people on the road. Good governance means making every mechanism of the state people-oriented and providing services according to the needs of the people. It is necessary to make the bureaucracy agile and sound and develop it as a people-friendly structure.
At first, the king’s work was sometimes called Jala Gham. But after 046 years, multi-party system started and different unions of parties were formed. Party sister organizations were also started for government employees. There were problems such as division of staff, delay in services to common citizens, inability to develop a fast and easy system using modern technology. Even after the 062/63 movement, the democracy and the republic came, that tradition of employees continued. According to former secretary Umesh Mainali, “Except for some reforms and constitutional-legal arrangements, the special work of strengthening and improving the public administration has not been done even after the second people’s movement. Rather, things like politicization, indiscipline and decline in morals are increasing in the overall administration.”
There is no timely review and improvement of the questions raised from time to time about the bureaucracy. In Nepal, changes in policy after government have caused political instability. On the other hand, we have a problem because the law is not clear, even though one law after another has been made, it has not been implemented properly. Even when people go to pay taxes, they have to stand in long queues, wait for a long time for citizenship, passport, driver’s license, etc. Sometimes it is said that national identity card is required, sometimes it is not required and it has not been provided on time. If the system could be developed, a large number of employees would not be required.
Due to the lack of policy and the existing policy not being clear, the working environment not suitable, political pressure and interference, lack of willpower among the employees, the people have to bear the suffering when the public’s work is not done on time. The people thought that with the political change, the service facilities they would get from the state would be easier and better and their living would be easier. But even when the political system changed, there was no improvement because the administrative system remained the same.
According to the principle of separation of powers and control and balance, three parts of the state, the judiciary, the executive and the legislature, have been formed so that no one part of the state can be arbitrary. Tokaraj Pandey, Joint Secretary, writes in Naya Patrika, “People-oriented and citizen-participatory governance is good governance. It carries the expectation of development, prosperity and people’s satisfaction. To maintain good governance, it is the need of the day to develop citizen awareness by making all parts of the state machinery dynamic, participatory and accountable.
At one time scriptures were considered as laws.
The laws of Nepal were mainly based on Hindu jurisprudence. In some countries, the Law of Moses was implemented under the Abrahamic faith. Similarly, there are countries where Islamic laws are applied. The scriptures teach people to be decent and disciplined, but now the context has changed. Emphasis is placed on the rule of law. Justice should be quick, efficient and accessible. According to Balram KC, a former judge, “Though three constitutions have been implemented since 2047, the judiciary has not been run.” The Supreme Court is becoming unable to deliver justice quickly. Pacey climbs up from the bench and goes back saying that he will not be sent to see. The people and the government are suffering from the delay in justice.”
It would not be an exaggeration to say that bureaucracy and justice system are the basis of good governance. It is not a good practice for employees to accuse political leaders and political leaders to accuse employees. It is natural for people to expect fast and easy service. Since the concept of good governance cannot be followed at all levels, it has had a negative impact even at the lower level. For the sustainable development and prosperity of the country, there is a need today to make the bureaucracy and justice system agile, fast and easy.
